On June 26, 2009, the U.S. House of Representatives narrowly approved game-changing climate change legislation, the American Clean Energy and Security Act (ACESA), also called Waxman-Markey (HR 2454) -- the first major environmental legislation to be approved by either the House or the Senate in almost twenty years. The come-from-behind 219-212 vote took place amidst defections by supporters in industry and environmental organizations alike, with even the White House expressing concern about global trade impacts as the vote approached. The bill requires a 3% cut in CO2 emissions from 2005 levels by 2012, 17% by 2020, 42% by 2030, and 83% by 2050.  This would transform the US economy and in particular the energy sector, and create a multi-billion dollar new market in valuable rights to emit greenhouse gases.

Speakers:

  • Phil Chandler – Head of Subfab and Environmental Products, Applied Materials
  • Denise Sheehan – Vice President, Government and Regional Affairs, The Climate Registry
  • Steve Frenkel – Chief Policy Advisor, Illinois EPA
  • Geraldine E. Edens – Partner, McKenna Long & Aldridge LLP

On Sept. 22, 2009, the Environmental Protection Agency announced its final rule for a national mandatory greenhouse gas reporting requirement. The rule, which is expected to cover approximately 85 percent of all U.S. GHG emissions from nearly 10,000 facilities, includes many changes from the draft rule. Although the emissions threshold level remains at 25,000 metric tons of carbon dioxide equivalent per year, the source categories covered by the rule have changed. Another key change allows facilities covered under the rule to cease reporting if their emission levels fall under the threshold level for a certain period of time.

ACCO, BNA and The Climate Registry invite you to a presentation on the final rule, with an interactive question-and-answer session and commentary and analyses on the rule, impacts on industry, and next steps for covered entities.  During the two-hour presentation, the panelists:

  • Reviewed the final mandatory GHG reporting requirement;
  • Highlighted differences between the final rule and the proposed rule published earlier this year;
  • Identified measures that industry must take to prepare to meet the requirement;
  • Discussed the reporting requirement in the context of other recent climate change policy activities (e.g. Kerry-Boxer Senate bill, EPA’s recently proposed rule to regulate GHG emissions under the Clean Air Act, and President Obama’s executive order to federal agencies); and
  • Assessed how and if states and regional climate pacts will harmonize their activities with EPA’s efforts.

Overview of EPA's Proposed Greenhouse Gas Tailoring Rule for Air Permitting Programs Association of Climate Change Officers
Webcast Nov. 9, 2009
1:00pm - 2:00pm (eastern)

Speakers:

  • Joe ManginoOffice of Air Quality Planning and Standards, Air Quality Policy Division, US EPA
  • Howard Hoffman Air and Radiation Law Office, Office of General Counsel, US EPA

On September 30, 2009, EPA announced a proposal that is focused on large facilities emitting over 25,000 tons of greenhouse gases a year. These facilities would be required to obtain permits that would demonstrate they are using the best practices and technologies to minimize GHG emissions.  The rule proposes new thresholds for greenhouse gas emissions (GHG) that define when Clean Air Act (CAA) permits under the New Source Review (NSR) and title V operating permits programs would be required for new or existing industrial facilities.  The proposed thresholds would “tailor” the permit programs to limit which facilities would be required to obtain NSR and title V permits and would cover nearly 70 percent of the national GHG emissions that come from stationary sources, including those from the nation’s largest emitters—including power plants, refineries, and cement production facilities.

  • Norman F. Carlin Partner, Pillsbury Winthrop Shaw Pittman LLP
  • Geraldine E. Edens Partner, McKenna Long & Aldridge LLP
  • Fred R. Wagner Principal, Beveridge & Diamond PC
  • Moderator: Howard Learner Executive Director, Environmental Law & Policy Center

As Federal and state government agencies explore various approaches to regulating climate change and energy, the National Environmental Policy Act (NEPA) and its state counterparts are increasingly playing a key role in the debate.

A recent statement issued by CEQ Chairwoman Nancy Sutley suggested that while greenhouse gas emissions could not be regulated under the National Environmental Policy Act (NEPA), "NEPA compels Federal agencies to consider environmental effects before undertaking significant actions or policies [and that] CEQ sees no basis for excluding greenhouse gas emissions from that consideration."

Additionally, high profile alternative energy projects have been held up in the courts and in the permitting process as part of the environmental impact analyses under NEPA and state counterparts.  The controversial Cape Wind project exemplifies one of such matters.

The Association of Climate Change Officers and BNA invite you to a discussion featuring leading NEPA practitioners who will discuss recent NEPA and state counterpart activity related to climate change and alternative energy.

University endowment funds account for more than $400 billion in combined assets, while pension funds account for trillions of dollars in investments. Recent media coverage of student and activist rallies on college campuses related to university endowments has compared the role of fossil fuel investments to that of tobacco investments in previous decades.  Meanwhile, the City of Seattle has just announced an intention to take on a divestment approach with respect to its pension fund.

With education costs increasing annually, and the number of endowments and pension funds applying principles of environmental, social and corporate (ESG) governance in decline, developing strategies for achieving financially practical outcomes while addressing climate related risks is imperative. Please join us a for 1-day workshop in Washington, DC (and available via webinar simulcast) examining practical approaches to tackling this challenging issue.

DOE's Superior Energy Performance Program: Driving Energy Efficiency and Productivity in the U.S. Manufacturing Sector

The Superior Energy Performance (SEP) program is a U.S. Department of Energy initiative targeting the U.S. Manufacturing sector. Facilities certified to Superior Energy Performance® (SEP™) are leaders in energy management and productivity improvement. The facilities in SEP have met the ISO 50001 standard and have improved their energy performance up to 25% over three years or up to 40% over 10 years.

SEP provides guidance, tools, and protocols to drive deeper, more sustained savings from ISO 50001. To become certified, facilities must implement an energy management system that meets the ISO 50001 standard and demonstrate improved energy performance. An independent third party audits each facility to verify achievements and qualify it at the Silver, Gold, or Platinum level, based on energy performance improvement. This certification emphasizes measurable savings through a transparent process.  DOE is exploring expanding the SEP program to other sectors, such as, water and wastewater, large commercial buildings and university campuses.

Webinar participants will learn about the SEP program and hear perspectives from leaders at Cummins and Harbec that have achieved SEP certification at their facilities.
